Medical Law

Medical law is an interdisciplinary branch of law that deals with all legal issues related to medical science in the fields of private law, criminal law and administrative law. Medical law is frequently recognised in medical malpractice cases.

Malpractice is defined in Article 13 of the Code of Ethics of the Turkish Medical Association as the malpractice of medicine and is defined as the harm to a patient due to ignorance, inexperience or indifference. Some of the areas where the physician falls into medical malpractice are;

Diagnostic Error (incorrect, incomplete diagnosis)
Treatment and Post-Treatment Care, Breach of Surveillance Obligations
Organisational Errors and Service Defects Regarding Institution and Treatment Services

The damages caused by physicians or hospitals to their patients during medical interventions may cost the lives of people or cause deterioration of their physical or mental health. All these undesirable situations give rise to legal liability of physicians and hospitals. The source of the physician’s liability may be tort, breach of contract, and acting without a power of attorney, etc. In this context, patients have the right to demand material and moral compensation.

Physicians and all other healthcare professionals are also criminally liable for the damages they cause to patients. For this reason, it is possible to be a perpetrator for the offences of negligent killing or negligent injury, intentional killing or injury, negligent killing or injury, protection of private life-personal data, etc.
