Human Rights Law

Article 12 of the 1982 Constitution states that “everyone has inviolable inalienable fundamental rights and freedoms attached to his personality”. Some of the fundamental rights regulated in the Turkish Constitution are as follows: Yaşam hakkı, kişi dokunulmazlığı, kişi hürriyeti ve güvenliği, özel hayatın gizliliği ve korunması, yerleşme ve seyahat hürriyeti, din ve vicdan hürriyeti, düşünce ve kanaat hürriyeti, bilim ve sanat hürriyeti, basın ve yayınla ilgili hürriyetler, mülkiyet hakkı, sağlık çevre ve konut hakkı vs. In addition to these rights, those that are protected under the ECHR can be the subject of an individual application to the Constitutional Court, such as life, personal liberty and security, private life, family life, housing and communication, freedom of thought and expression, fair trial, prohibition of torture, etc.

In general terms, Human Rights Law is a branch of public law that deals with the rights arising from the fact that human beings are human beings. Within the scope of human rights, the rights in the constitution of the relevant country constitute fundamental rights. Issues such as what fundamental rights consist of, the authority to dispose of these rights and their scope, the limitation and protection of fundamental rights are among the fields of human rights law.

GA Law Office provides legal counselling and legal advice on individual applications to the Constitutional Court and the European Court of Human Rights.
